What is the micase RTA platform?

The micase RTA platform is an innovative self-service online claims portal which has revolutionised the way we access legal services. Following the whiplash reforms, there's no need to go it alone as a Litigant in Person. Micase provides expert legal advice and representation at your fingertips, without any financial risk to you.

As the process to make a whiplash claim has changed due to the Civil Liability Act and the whiplash reforms, the micase platform is the perfect solution as you’ll be able to access expert legal representation without the risk of being left out of pocket, as your case will be run on a No Win No Fee basis. Why has the process to claim for whiplash injuries changed?

The Association of British Insurers (ABI) reported that there were more than 1,500 whiplash claims made in the UK every day, which cost the insurance industry an estimated £2 billion per year.

As a result, the Government introduced the Civil Liability Act 2018 and the Whiplash Injury Regulations, more commonly known as the whiplash reforms, in an effort to reduce the amount whiplash claims were costing the insurance industry. The move is a positive one, as the savings the insurance companies make must be passed on to their customers, and as a result, the Government expects that motorists will save approximately £35 per year on their motor insurance premiums.

The whiplash reforms were implemented on 31 May 2021, after delays due to the Covid-19 pandemic, and have changed the process for making a whiplash claim.

What has the whiplash reforms changed?

Before the whiplash reforms were implemented on 31 May 2021, if your whiplash claim for pain, suffering and loss of amenity (loss of enjoyment/quality of life) was worth over £1,000, as well as receiving compensation, your reasonable legal fees would be paid by the insurer of driver at fault for the accident. The whiplash reforms changed the £1,000 threshold to £5,000 which impacts the vast majority of people who suffer whiplash in a road traffic accident, as the amount of compensation for pain, suffering and loss of amenity for a whiplash claim usually falls below £5,000.

Additionally, the amount of compensation you can get for a whiplash claim has also been reduced. The new tariff amounts range from £240 to £4,215, depending on how long your injury lasts and £260 to £4,345 if you also have minor psychological injuries.

As insurance companies will no longer have to pay legal fees for the majority of whiplash claims, and the amount of compensation you can receive for a whiplash injury has been reduced, this will save them a significant amount of money.

How will the whiplash reforms affect those who wish to claim compensation for whiplash?

The Ministry of Justice (MoJ) have introduced an online self-service portal system called the Official Injury Claim (OIC). If you choose this method to make a claim for whiplash injuries, you’ll have to bring the claim yourself as a ‘Litigant in Person’, which basically means you’ll be acting on behalf of yourself without legal advice or representation.

There are challenges which may be faced when representing yourself as a Litigant in Person, and it may be a stressful and complex process.

You're still entitled to seek legal representation but should be careful that you read the terms and conditions as if you’re charged hourly rates for representation, there’s a risk that their fees will cost more than the compensation you receive, so you may end up out of pocket.

How does micase RTA work?

The micase platform is simple, straightforward and easy to use. Simply create an account, then complete a questionnaire about your accident and your injuries. We estimate that the questionnaire takes approximately 10 minutes to complete.

Once your questionnaire is complete, there’s a short video to watch before you sign your contract. Your contract sets out your No Win No Fee agreement with us.

Once your claim is verified, we’ll submit the claim on your behalf. You’ll be provided with notifications updating you throughout your case and informing you when we need to take your instructions.

You’ll be able to log onto the micase platform at any time to see the progress of your case and once complete, you’ll receive your compensation, without the hassle of having to deal with the claim yourself.

How does the micase RTA No Win No Fee agreement work?

The No Win No Fee agreement does what it says on the tin. If you don’t win your case, you don’t have to pay anything. If you do win your case, we’ll take a 25% fee from your compensation. That way, there’s no risk of being left out of pocket.
